Terms of Service

1. Acceptance of Terms

By accessing or using PitchMint ("Service"), operated by DQ Digital LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PitchMint is an AI-powered business proposal generator that helps users create professional proposals using artificial intelligence. Our Service includes:

  • AI-generated business proposals using OpenAI's GPT-4
  • PDF generation and download capabilities
  • Proposal management and storage
  • User account management
  • Subscription-based premium features

3. User Accounts

3.1 Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for safeguarding your account password
  • You must be at least 18 years old to use this Service
  • One person or legal entity may not maintain more than one account

3.2 Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Plans and Billing

4.1 Plan Types

  • Free Plan: Limited to 3 lifetime proposals with watermarked PDFs
  • Pro Plan: Unlimited proposals with clean PDFs and premium features
  • Trial Period: 7-day trial with full Pro features for new subscribers

4.2 Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We use Stripe for payment processing
  • Prices may change with 30 days' notice to existing subscribers

4.3 Automatic Renewal

  • Subscriptions automatically renew unless cancelled
  • You may cancel anytime through your billing settings or Stripe customer portal
  • Cancellation takes effect at the end of the current billing period

5. Acceptable Use

5.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use automated scripts to generate excessive API requests
  • Reverse engineer or copy our AI algorithms
  • Share account credentials with others
  • Generate content that is defamatory, fraudulent, or misleading

6. Intellectual Property

6.1 Our Rights

  • PitchMint is owned and operated by DQ Digital LLC. All rights to the Service, software, algorithms, and branding belong to DQ Digital LLC.
  • Our trademarks and logos may not be used without permission
  • The underlying AI technology and prompt engineering remain our proprietary assets

6.2 Your Rights

  • You retain ownership of content you input into the Service
  • You own the generated proposals created through our Service
  • We grant you a limited license to use our Service according to these Terms

6.3 Generated Content

  • Proposals generated by our AI are provided "as is"
  • You are responsible for reviewing and validating all generated content
  • We do not guarantee the accuracy or completeness of AI-generated content

8. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • Excessive API usage may result in rate limiting

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages

10. Indemnification

You agree to indemnify and hold harmless DQ Digital LLC and PitchMint from any claims, damages, or expenses arising from your use of the Service.

11. Termination

  • You may terminate your account at any time through your settings
  • We may suspend or terminate your account for violating these Terms
  • Data may be deleted after a reasonable grace period

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms. Material changes will be communicated via email.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.
